The 33-year-old Jurupa Valley man charged with three felony counts of attempted murder is due back at Pomona Superior Court for a preliminary hearing setting on Wednesday, August 6.
Erik William Guevara, who was arrested by the Claremont Police Department following a January 23 shooting in the 600 block of Colgate Place that left two men injured, faces three felony counts of attempted murder and one felony count of being a felon in possession of a firearm. All charges were given an enhancement relating to “one or more [prior] series/violent felony convictions.”
Guevara pleaded not guilty to all charges on February 18. He could face five life sentences if convicted on all counts, according to a spokesperson for the LA County District Attorney’s Office.
One attempted murder charge was given a Penal Code 12022.53(c) enhancement and two received PC 12022.53(d) enhancements. Enhancement “C” would add 20 years to a sentence if the defendant “…personally and intentionally discharges a firearm.” Enhancement “D” would add 25 years if the defendant “…personally and intentionally discharges a firearm and proximately causes great bodily injury, … or death, to a person other than an accomplice.”
The case stems from the January 23 incident, when Claremont police responded to reports of a shooting in the 600 block of Colgate Place at 7:23 p.m. Witnesses reported seeing a man checking for unlocked car doors, then finding one in a driveway, where two men emerged from a home and were shot after confronting the man. A third person then emerged from the home and subdued the gunman until police arrived, according to witnesses.
The two victims and Guevara were taken to Pomona Valley Hospital Medical Center. Once treated and released, Guevara was arrested by Claremont police.
Los Angeles County inmate records indicate Guevara has prior cases in Riverside County.
In April 2017 Guevara was arrested in Riverside County and charged with felony criminal threats. On May 17, 2023 he was arrested and charged with felony possession of a stolen vehicle and for a felony Riverside County warrant. On March 17, the Riverside County Probation Department, which oversees those on post-release community supervision, filed a petition with the Riverside court to revoke Guevara’s post-release community supervision, according to court records. The next day, the court ordered Guevara’s post-release community supervision revoked and issued a no-bail bench warrant for “failure to comply with PRCS.”
At press time Guevara remained in the custody of the LA County Sheriff’s Department in lieu of $7 million bail.
He is due at Pomona Superior Court’s Department N at 8:30 a.m. August 6 for a preliminary hearing setting.
