The Jurupa Valley man charged with three counts of attempted murder after a January 23 shooting in Claremont was back in Pomona Superior Court May 8.
Erik William Guevara, 33, waived a preliminary hearing setting according to the LA County District Attorney’s Office. It was continued to June 25.
Guevara was arrested following a shooting in the 600 block of Colgate Place that left two men with gunshot wounds. The two injured victims and Guevara were taken to Pomona Valley Hospital Medical Center. Their condition is unknown. After Guevara was treated and released, he was arrested by Claremont police.
Guevara is charged with three felony counts of attempted murder, California Penal Code 664-187(a), and one felony count of being a felon in possession of a firearm, CA PC 29800(a)(1). All charges were given a PC1170.12enhancement relating to “one or more [prior] series/violent felony convictions.”
One attempted murder charge was given a PC 12022.53(c) enhancement and two received PC 12022.53(d)enhancements. Enhancements “C” would add 20 years to a sentence if the defendant “…personally and intentionally discharges a firearm.” Enhancement “D” would add 25 years if the defendant “…personally and intentionally discharges a firearm and proximately causes great bodily injury, … or death, to a person other than an accomplice.”
Guevara pleaded not guilty to all charges on February 18. He could face five life sentences if convicted on all counts, the DA said.
At 7:23 p.m. January 23, Claremont police responded to reports of a shooting in the 600 block of Colgate Place. Witnesses reported seeing a man checking for unlocked car doors, then finding one in a driveway. After apparently seeing someone in the car, two men emerged from the home and were shot after confronting the man, according to witnesses. A third person then emerged from the home, was shot at, but managed to subdue the gunman until police arrived.
Guevara remains in custody at Men’s Central Jail in Los Angeles in lieu of $7 million bail.
